Eric H. Tsugawa concentrates his practice in the areas of construction law and litigation, general commercial litigation, mediation and arbitration, condemnation proceedings, collection, foreclosure, business and general corporate matters. His work more specifically includes the following:
Construction Law and Litigation:
Represents developers/owners, general contractors, subcontractors, material suppliers and design professionals in contract negotiations, contract disputes, mechanic's lien and bond claims, federal and state contract claims, construction defect litigation, and mediation and arbitration of construction disputes. Construction defect litigation experience includes complex litigation involving large multi-million dollar commercial and residential projects such as Country Club Plaza (represented structural engineer in a case involving a high rise condominium), The Masters at Kaanapali Hillside (represented the developer in a case involving a multi-family low rise development) and Aloha Stadium (represented the general contractor in a case involving the State-owned 50,000 seat capacity stadium).
General Commercial Litigation:
Represents parties in business and real estate disputes involving partnerships and corporate matters, real estate transactions, landlord and tenant issues, and commercial lease matters.
Mediation/Arbitration:
Represents parties in the mediation and arbitration of commercial disputes, including real estate transactions, and contract and construction matters. Serves as a court appointed arbitrator in the Court Annexed Arbitration Program.
Condemnation Actions:
Represents owners and other parties with interests in land being condemned through eminent domain proceedings.
Collections and Foreclosure:
Represents debtors and creditors, including financial institutions, banks and other lenders, in collection matters and judicial and non-judicial foreclosures.
Business and General Corporate:
Represents parties in the sale and purchase of businesses, incorporation and organization of business entities.
